Please read these Terms of Service ("Terms") carefully before using the আমার সিটি mobile application and website (collectively, the "Service") operated by আমার সিটি ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access the Service.
1. Acceptance of Terms
By creating an account or otherwise using the Service, you represent that you are at least 13 years of age and that you have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date above. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
2. Use of the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes.
You agree not to:
- Use the Service in any way that violates applicable local, national, or international laws or regulations.
- Attempt to gain unauthorised access to any part of the Service or its related systems.
- Use automated scripts, bots, or scraping tools to access or extract data from the Service.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Post or transmit content that is defamatory, obscene, fraudulent, or otherwise objectionable.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer, decompile, or disassemble any portion of the app's software.
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, if we believe you have violated these Terms.
3. User Submissions
The Service allows you to submit listings, reviews, photos, and other content ("Submissions"). You retain ownership of any intellectual property rights you hold in your Submissions. However, by submitting content, you grant us a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, modify, publish, and distribute that content in connection with the Service.
You represent and warrant that:
- You own or have the necessary licences and rights to submit the content.
- Your Submissions are accurate and not misleading.
- Your Submissions do not infringe any third-party intellectual property, privacy, or other rights.
- Your Submissions comply with these Terms and all applicable laws.
We reserve the right (but not the obligation) to review, moderate, edit, or remove any Submission at our discretion without notice, especially if it violates these Terms or our community guidelines.
4. Intellectual Property
The Service and its original content (excluding user Submissions), features, design, and functionality are and will remain the exclusive property of আমার সিটি and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of আমার সিটি.
The app's source code, graphics, logos, and user interface elements are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without express written permission from us.
5. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free.
- The information provided through the Service (including listing details, addresses, and hours) is accurate, complete, or current.
- Any errors in the Service will be corrected.
Listing information is submitted by users and has not necessarily been verified. You are responsible for independently verifying any information before relying on it.
6. Limitation of Liability
To the fullest extent permitted by applicable law, আমার সিটি and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the Service.
In no event shall our total liability to you for all claims arising out of or related to the Service exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) BDT 500 (five hundred taka).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
7. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 14 days' notice prior to the new terms taking effect (for example, via an in-app notification or an email to your registered address).
What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh.
